General terms and conditions of sale

1. Scope of application

These general terms and conditions apply to all registrations and orders placed between POTSFINK / Peter Fink via the potsfink.ch website.

2. Conclusion of contract

By submitting an order and simultaneously accepting these GTC, the purchaser makes a legally binding offer to enter into a contract. The contract is concluded when the purchaser receives an order confirmation from the seller. The order confirmation will be sent by e-mail (or by post).

3. Prices

The prices indicated for POTSFINK offers are exclusively in Swiss francs (CHF).
The product prices shown on the website include VAT at 8.1%. Courses are not subject to VAT.
The invoice amount is due within 30 days of the invoice date. In the event of late payment, we charge default interest of 2% per month on the amount due. In addition, we charge a reminder fee of CHF 25 for each reminder, which is added to the amount due and the default interest.

4. Products

Ceramic orders are payable immediately. As a general rule, products in stock are dispatched on receipt of payment.

5. Right of return

The buyer has the right to cancel his purchase within 14 days of receiving the goods. The cancellation must be sent to POTSFINK in writing, by e-mail or by letter. The exercise of the right of withdrawal results in the transformation of the sales contract into a cancellation relationship.

The buyer must return the goods received to POTSFINK in their original packaging within 14 days of the declaration of withdrawal. Returns to POTSFINK are made at the expense and risk of the customer.

Upon receipt of the goods, the purchase price, if already paid, will be immediately refunded to the consumer. We reserve the right to make a deduction for any damage or excessive wear to the goods. Shipping costs will not be refunded.

Products made to measure, or in a specially created colour, cannot be returned.

6. Duty of examination, liability for defects

POTSFINK works with natural materials. Deviations in size, structure and colour from the illustration in the online shop and the use of the product are unavoidable and therefore do not constitute defects.

In particular, kiln-proof ceramics will crack with use, which is normal and is characterised by good thermal shock resistance.

7. Guarantee

POTSFINK endeavours to deliver goods of impeccable quality. The purchaser must inspect the delivered goods as soon as possible and report any defects immediately in writing, at the latest within five working days.

It is at POTSFINK’s discretion to provide the guarantee in the form of a free repair, an equivalent replacement or a refund of the purchase price. All other claims are excluded.
Returns to POTSFINK are at the expense and risk of the buyer. The buyer must return the goods to POTSFINK in their original packaging, complete with all accessories. The goods must be returned to POTSFINK with a copy of your invoice, which you received by e-mail.

Postage costs for any return for exchange or repair of defects are at the buyer’s expense. The purchase price will either be reimbursed or replaced free of charge. Customs duties, taxes and initial shipping costs will not be refunded.

8. Liability

POTSFINK declines all responsibility for the use of the products.

9. Collection, delivery

All items ordered can be collected by appointment from POTSFINK, Peter Fink, Route du Petit-Ependes 3, 1731 Ependes. There are no additional costs for collection by the customer.

We use the services of third parties (post office) to deliver the items ordered. Shipping costs are charged by weight. It should be noted that for certain particularly heavy or delicate items, it is not recommended or possible to ship them. Delivery is made directly to the delivery address indicated by the buyer. The seller is not responsible for damage or delays caused by manufacturing companies or third parties. Any transport damage must be reported immediately to the delivery company.

Delivery costs are calculated as follows: Packages < 2kg=CHF 15, <10kg=CHF 20, >10kg=CHF 30, deliveries abroad or >35kg are notified in advance.

10. Liability

All other claims by the purchaser, irrespective of the legal grounds, are excluded to the extent permitted by law. The seller is at no time liable for damage not caused to the goods themselves, in particular for consequential damage or other damage suffered by the buyer.

11. Courses, subscriptions and workshops

Registration for a specific course is only taken into account when payment is made via the site.

Courses are fixed with a minimum and maximum number of participants. Registrations are taken on a first come, first served basis. POTSFINK will decide whether or not to hold a course approximately 10 days before it is due to start. If the number of registrations is insufficient, POTSFINK reserves the right to cancel the course. If the course leader is absent, POTSFINK reserves the right to change the leader or to call in a replacement. If POTSFINK cancels a course, the full course fee will be refunded.

In accordance with standard practice, modules/units/individual days not taken cannot be made up and will not be refunded.

Exception at POTSFINK and for regular courses only: if 48 hours’ notice is given, a discount code of CHF 40 on the next course will be given to the participant.

For subscriptions, the period of validity begins as soon as payment is made.On expiry of the validity of a subscription, any remaining credit is lost without compensation. Subscriptions are personal and cannot be transferred to third parties.

Different arrangements may be made in the event of long-term illness or in cases of hardship. In particular, it is possible to be replaced, provided this is for the entire duration of a course.

All cancellations must be made in writing. The postmark or the date of the e-mail will be taken as proof of the date.The following non-negotiable refund charges apply from the date of enrolment:

– up to 60 days before the start of the course: 25% of the course fee

– from 59 to 22 days before the start of the course: 50% of the course fee

– after 21 days before the start of the course: 100% of the course fee

Participants can also take out specific cancellation insurance with their insurance company.

For all courses and events organised by POTSFINK, any liability for damage caused is excluded.Participants are responsible for ensuring that they have sufficient insurance cover.Use of the Poterie d’Ependes is at the participants’ own risk and POTSFINK accepts no liability for theft or loss of objects.By registering for the course, participants expressly consent to POTSFINK recording and processing their personal data and using it for its own purposes (e.g. invitations, newsletter, advertising, statistics).This consent may be revoked at any time in writing.POTSFINK reserves the right to take photographs and films on site for its websites, social media portals (e.g. Facebook, Instagram) and publications.This will only be done after verbal agreement with the course participants concerned.The costs of firing the pieces will be invoiced at a later date or collected in cash. 12. Changes

POTSFINK reserves the right to modify the programme, prices and general terms and conditions of sale. The version in force at the time of registration is authoritative and cannot be unilaterally modified for the conclusion of this contract.

13. Applicable law / jurisdiction

The applicable law for both parties (POTSFINK and customers) is exclusively Swiss law. The place of jurisdiction is Fribourg.
